Assault with a deadly weapon

Assault With a Deadly Weapon is the term used to describe the act of threatening to harm one or more people by using a weapon (usually a firearm). Here, Assault must be differentiated from Battery (crime) as they are often confused. Assault is threatning to use force. Battery is the action of using force, such as striking a person.

Interpretations of this term can vary based on local statute. For example: in Illinois it is known as aggravated assault, and occurs when an individual brandishes (but does not fire) a firearm (or something appearing to be a firearm) at another person. Template:Crime-stub
